Classification Before Notification

Whether a product is a cosmetic depends on its composition, intended use, presentation, and claims. Acne treatment, sunscreen, therapeutic, disinfectant, structure/function, or disease claims can move a product into another regulatory category. Classification should be settled before final labels, advertising, or notifications are prepared.

Canada

Canadian cosmetics must comply with the Food and Drugs Act and Cosmetic Regulations. Companies should review ingredients against the Cosmetic Ingredient Hotlist, prepare compliant bilingual labels where applicable, maintain safety support, and submit the required Cosmetic Notification Form within the prescribed timeframe after first sale. A notification is not an approval, and Health Canada may request additional information.

United States

In the United States, cosmetics are regulated under the Federal Food, Drug, and Cosmetic Act as modernized by MoCRA. Depending on the business and product, obligations may involve facility registration, product listing, safety substantiation, adverse-event records and reporting, records access, and updated labelling. Statutory exemptions and implementation details must be assessed carefully against current FDA guidance.

European Union

EU Regulation (EC) No 1223/2009 places responsibility on the designated Responsible Person. Before market placement, companies generally need a safety assessment and Cosmetic Product Safety Report, Product Information File, good manufacturing practice, compliant labelling, and notification through the Cosmetic Products Notification Portal. CPNP notification does not replace the underlying safety and compliance duties.

One Product, Three Compliance Files

A global formula and brand can still require different claims, warnings, language, ingredient naming, representation, notification, and records. Build a market matrix that separates common evidence from jurisdiction-specific deliverables, and control label versions by market.

Global Regulatory Submissions Inc. can support ingredient and claim reviews, notification planning, document coordination, label gap assessments, and selected market-entry activities.
